A water rights adjudication is a court process that determines and confirms who has the right to use water, in what amount, from what source, and with what priority.

What it means in practice

Adjudications can include surface and groundwater and often involve many parties. The court creates an authoritative inventory of rights, which can affect permitting, enforcement, and environmental protections.

Why it matters for rights of nature

Adjudication is one place where a river’s interest in instream flows can be articulated and protected, especially when a basin is over-allocated or ecologically stressed.
