Preemption

Quick definition

Preemption is when a higher level of law limits or blocks a lower level of law from operating, for example, state law overriding a local ordinance.

What it means in practice

If a city passes a law and the state has occupied the field, or expressly forbids local regulation in that area, the local law may be challenged as preempted. Preemption can be partial (some parts survive) or broad.

Why it matters for rights of nature

Many rights-of-nature measures face preemption arguments. Understanding the concept helps explain why some strategies work better at certain levels of government.
