Jurisdiction is a court’s legal authority to hear a case and issue binding orders over the parties and the subject matter.

What it means in practice

Even if you have a strong claim, the wrong court can’t help you. Jurisdiction questions include which court, which level (state or federal), and whether the court has authority over the defendant and the type of claim.

Why it matters for rights of nature

Rights of nature cases often intersect with state and local law, federal law, and tribal law. Jurisdiction fights are common early in litigation.
